Christmas went really well. Jeremy and I both got more than we ever expected, and it was nice being with the families. Although, any warm and fuzzy feelings I had towards Jeremy's parents where quickly negated after Saturday night.

I've been reading and cleaning the house, and catching up on movies that we haven't been able to watch. I hope to have to the book that Jeremy got me for Christmas done before I go back to school on Thursday. I am working at Walden drive from 2:30 until 6:30, which seems like a very weird shift to me. Then, I think we are going over to Chris' mom's house to ring in the new year. I haven't been feeling well this morning, so hopefully I will feel better.

I've been cold all day. I turned up the heat and even curled up in front of the fireplace to warm up while I was reading, and I am still cold. Hopefully they have the head pumping at the pharmacy.

FAMILY, I WILL BE BRINGING CORNBREAD AND STUFFING!!!!!!!

Yesterday I spent a couple of hours going through the filing cabinet cleaning out all of 2006's stuff that we don't need to keep. Then, I went and worked out and felt much better about myself. Vacationing and finals and losing my student id really threw me off track. and the gym is closed all this week for the holidays, so that makes me sad. so I guess I will be pulling out the old exercise tapes and the weights. I feel so depressed sometimes when I'm feeling gross. the two go hand and hand I guess.

I have to go in to work at Walden drive, then I get off work at 3, drive home and will be leaving immediately to get to ashland. we are suppose to be at his Aunt's house at exactly 5, which I don't really understand because it's just socializing, not a planned event or anything. I'm sort of bitter about the whole thing because the last couple of years there has been NOTHING for me to eat there, so I've had to eat plain bread (the other bread had ham cooked in it) and soup that Jeremy's mom makes special for me. Jeremy is taking a half day at work and will be coming home early to make cornbread stuffing to take.

We made it home safe from Virginia Beach. It took up 11 hours, but we were delayed in Ashland for an hour when we stopped to pick up the puppies.

I got up this morning and finished the rest of the Christmas shopping and Jeremy is out right now finishing up his. he had to stop by the Aunts to drop off presents for his mom and he went and worked out too today.

After I finished wrapping presents, I took a nap and then I cleaned the back bedroom. it was pretty gross and really needed a good scrubbing.

Christmas eve we are heading to Ashland and then Christmas day to Louisville.

we made it to Virginia Beach ok. Yesterday we spent the morning and afternoon at Yorktown and Jamestown, and then we went to Mona's for dinner and to play some Wii.

This keyboard is sorta stinky, so I won't write much except that our hotel room is very nice and we are going to walk down the desert strip this morning before heading back over to Mona and Greg's to spend time with them until it is time for Greg to go to work. then we are going shopping.

We are having a blast in Williamsburg, although the amount of rude people here is astonishing. I think it may be a Virginian thing or something. At one point yesterday, 5 different employers were really condescending and rude when we asked them or someone else in the group we were in asked them a question about colonial American. it was really strange. I just don't get it.

Sunday was at in Richmond at the Tara Thai, Monday morning we ate at the Gazebo pancake house, monday afternoon we ate at aromas cafe, that night we bought a pint of vanilla icecream and a pomergranide(sp?) and had that for dinner. It was good. WE got inspired by all the Christmas directions on the houses. ALl of the wreaths and stuff are made out of real material and include fresh fruit.

Today, we are going to Jamestown and Yorktown, then we are heading over to Virginia Beach. WE really need to get all of our Christmas shopping done before we get back to Kentucky because it is going to be crazy when we get back.

I gave into temptation and stopped at the zoo on the way home. I only stayed an hour because I had to get home to walk Missy but it was wonderful. The baby elephant is so cute. And the mom keeps him in line. She wanted him to move and he wouldn't so she moved him. It made me smile. I hope everyone got to spend sometime outside today while it's warm and maybe even when the sun was out briefly.

And then there was just a week left in the semester... had did that happen? Finals start next week, and I'm sorta ready, sorta note.

I still haven't found out my other five rotations, but I think they will have them up possibly next week. we had to submit them on Friday. i hope that I don't get Ashland.

my butt has been so sore from sitting so long and studying. I really so that my risk for a DVT has greatly increased this past week. my legs have been aching, and I can't even cross my legs when I study because they have been cramping so much.

Oh, and I got my hair cut. It is very short. the shortest I can ever remember it. it's sorta bugging me because it won't stay up in a ponytail holder.

Survived

I survived John's vacation and his cleaning out the basement. I really didn't want to mess with any of that when I got home from work but of course I got trapped going through things to see what I wanted to really keep. It made me angry especially since I've been half sick to have to work half the night after I came home tired for work. But now it's done and looks really different. The boys (and their parents) came over and we went downstairs to visit. They had plenty of space to run. And they saw the piano and asked when we got it. I guess the basement was a little crowded before since we got the piano from John's mom when I was pregnant with Virginia. It's not crowded now. I'm glad he's going back to work before he starts on another project.

it has been pretty much an all around crappy week. And I'm sure next week will follow the same path because I will be studying nonstop. I need to start studying now.

I worked last night and it was insanely busy. We had four techs working and a pharmacist, and we were all running around nonstop. which is so strange because we are usually a low volume store. it was just craziness. I guess everyone and their grandmother came out of the woodwork last night.

I am proud of myself because there was drama a bunch this week and I didn't let myself get involved. I just watched it pass by me and said whatever, which I am thinking should be my new philosophy in life. Whatever and leave me alone.

My rotations are decided, but no one can lo

I worked at Walden drive today and actually enjoyed it quite a bit. Much more than the last time that I worked there.

I'm sort of disappointed that I didn't study more this break, and when I mean study more I mean at all. Tomorrow, I don't work until 3, so hopefully I will get some things done in the morning. Then Sunday I am off all day. And I don't work again until Friday.

Last night we went to CompUSA again and got a few things, most noteably a new router and blue tooth headset for Jeremy for dirt cheap. But the excitment of our good buys were short lived when we got home and Jeremy realized that his work laptop was broken and the system wouldn't recognize the harddrive. So, he went to bed very distressed. I guess he wasn't that distressed because he woke up and headed out to Circuit city, best buy, and target this morning before he headed into work aorund 9. Anyways, he worked on his computer problem a couple of hours today, and got a lot of the problems fixed, and someone is coming to town on Monday to fix the rest.

I sorta don't like days like today, cuz I came home and ate a HUGE dinner and sat on my butt and channel surfed even though I know I have to get things done, like study, take care of bills, and send Katie a letter. but it's like I can't get motivated, you know? it's like I have to go to school everyday in order to get motivated and stay ontop of things.

Happy Dead Turkey day everyone!

So, the green beans, black eye peas, duck, mashed potatoes, cucumber salad, tomatoes/cucumber/onions and vinegar, yams, gravy, cornbread, and cornbread stuffing are underway or complete. We still need to fix the greenbean casserole, the lima beans, brocolli and cheese, and corn. and of course the pumpkin pie.

and then we will be eating for the next week on left overs:) Except for the stinky duck, the rest of the house smells really good
Happy Thanksgiving. Virginia and Jeremy, even though you are in Lexington you will be in my thoughts off and on today as I think of things I am grateful for since I am truly thankful for having you in my life. I hope all your dishes turn out wonderfully and that you don't burn the rolls like your Grandma Jolley used to do every Thanksgiving. Your dad has been telling the story of how you didn't add water to the vinegar for the tomato, cucumber and onion salad. It ranks up there with Rebecca and the Jalopeno as ones he likes to tell. It makes him smile. I'm enjoying a few minutes of quiet thanksgiving before your sisters and families get here. I wore my new coat to church this morning and it's really warm. I didn't wear long johns so my legs got cold walking into church. Yesterday was so warm that it makes today seem twice as cold. Stay warm and everybody reading this have a great Thanksgiving.

we forgot to get lima beans and broccoli and cheese last night. that makes me sad.

I have to work today. I'm fixing myself of quick lunch of pasta. I went a little pasta crazy and got like 20 different ypes of pasta at Meijer. they have 1 pound boxes of all these different types for 88 cents. that's a good deal.

Jeremy was real;ly cute last night. We went out to dinner and then to the store to get some stuff we needed for dinner tomorrow, and he stopped me and said "doesn't this shirt look good with these pants? they match". It was really funny.

Our dinner is going to be GOOOOOOOOODDDD. I'm excited about it. I think we are going to have pumkpin pie this year for dessert instead of cobbler. it was on sale last night at Kroger, and we couldn't pass it up. of course, we couldn't pass up the cool whip either. teehee
I got the coat I saw Saturday. It was 60 % plus 10% off so I got it around $30 cheaper than the 50% it was Saturday. It's going to be so warm if it ever gets cold.

Today I ran 4 miles and did weights. I think I went a little overboard though and I'm sure I will be hurting tomorrow. I don't have class at all tomorrow, but I am going in early to study and then I have to go get my yearly eye exam at 3:30. I'm finally getting new glasses, my first new pair I think since like highschool. It will be nice being able to put on glasses and keep them on longer than 20 minutes and not get a headache. I'll be able to actually study in them when I take out my contacts with they get too dry. Then, in January, I am going to get some more contacts and that should last me for a while. I think the next time around, I'm going to get that Lasix eye surgery.

Tomorrow, I hope that I will be up to running a couple more miles.

I really like that show Little People, Big World. And apparently they are in Paduca, KY next week.

Jeremy is so sweet sometimes. Sometimes I feel like we are still dating.

I miss my mother-in-law, Naomi. Especially at this time of year. She made Thanksgiving a way of life. She showed me how to unconditionally love. She made everyone feel like they were her favorite even when the whole crowd was there. She was amazing. I would have been lost without her example. Even now I do things to make her proud. I am a much better person because of her.

I've been busy. Lots of group projects. I'm not doing very well going into finals. it's going to be a struggle to get A's. it'll be interesting to see if I can do.

We plan out Thanksgiving dinner tonight. it's gonna be GOOOOD. I don't think we will make as much food this year though. last's years potatoes were alittle ridiculous.

We are planning on going to williamsburg and Virginia Beach as soon as I get done with finals week. Marriott has their free exchange for associates, so we are staying at Virginia Beach for free, and we are going to be seeing Jeremy's sister mona.

I'm so close to being done, I can taste it.

I have to work tomorrow night until 10. I also have a ettiquet (did I spell that right) thing to go to tomorrow afternoon. I don't have any nice clothes to wear to it and that makes me sad. I really do need to get some new profession clothes for when I got to my rotations.

hi all.

Man, it was nice today. When I got done working out today, I was able to walk to my car in shorts and a t-shirt because it was so warm out. I spent a couple hours at school working on some projects, and then I came home and cleared out the garden for the winter. And then I made chili for dinner. vegetarian of course. it was good.

The semester is going to be coming to an end soon. I have to get a A's in Cardio and Therapeutics on the final in order to pull an A in the classes. I didn't do very well the first set of blocks, and I can feel the pressure now.

He and his team made it for the first time in years.

What a marvelous, glorious day!! The sun is shining and everything is falling into place. I don't feel weak in my legs even after all the walking I've done. I woke up in time to attend church without the alarm. Afterwards I went to Sam's after the post office. I was just shopping, minding my own business, when the cutest little pine tree said "Look at me. Don't you really want to buy me?" What could I say? Of course, I put the tree in the cart and brought it home. It really looks pretty and fits just right. It has made me feel joyful. After Thanksgiving I may even put ornaments on it. Probably not lights, I don't want it to get burnt. On the way home from Sam's I voted. John beat me to the polls this year for a change. I took Missy to get groomed and while she was there I walked to Great Clips for grooming myself. I splurged and got my hair washed when I got my haircut. I have done that in ages. It feels so good. I felt good enough to walk to Steak and Shake for lunch. When I got back to my car, I drove to Hobby Lobby to fill up time waiting for Missy. They had most of their Christmas stuff 50% off so I was able to pick up a lot nicer presents for the people at work and Virginia's in-laws than I could have otherwise. Just as I put stuff in the car, I got the call Missy was ready. Perfect timing! She was happy to see me but once we got home she started giving me the cold shoulder. I can't believe I feel so full of energy. It's been a long time since I've felt this good. And I still have plans for tonight so it'll only get better.
tootsie rolls still look like poop but taste SOOOO good.

I got a book in the mail. a Spanish book:) Granted, now water damaged, but at least she sent it, right? wait... no.

I hate when I have weird dreams and it puts me in a bad mood when I wake up. it was horrible. Jeremy and I were living in this villa, and I was going to this baby shower that was really in a shower ( a gaint bathroom) so that the people throwing it wouldn't have to rent a room, which they would have to if it was over 25 people. Anyways, the pregnant chick was someone I had never met before, and these Asian business men showed up and striped down to their tighty whities and sat down in the bathtub. I asked why there were men and the shower, and the response was there had to be in order to get the giant bathroom without getting charged.

So then I was back in the villa with Jeremy and it was really beautiful, all open air and clay everywhere. we owned it, and these things kept on breaking, like a huge clay pot, and apparently two of the three toliets didn't work. And I went to sleep (in my dream) only to find Jeremy still at home when I woke up at 9:30 (he is suppose to be at work at 7). I ask him what was going on and he said he was just hanging out because he didn't feel like going to work yet. amd I started yelling at him that he needed to get his stuff together... the villa was falling apart and he wasn't going to work. then, he started crying, and flickering in and out of my sight, like a bad projection, and saying that he didn't like his job and he was going nowhere with it. Then he ran off, right when a bunch of elementary kids showed up to do an overnight stay at the villa. The last part of my dream, I was frantically trying to get clothes packed so that I could go workout, and I needed to do it quickly if I wanted to get a free Speedo bathing suit. Then Jeremy and I were in the Fit, and we were at Fairdale pool, trying to find a parking spot. But there was a huge football game going on, and all the parking was gone, and the only places left were handicap and tailgating. and people were swarming the car because they were late to the football game. So, Jeremy got out to tell people to clear away so we could drive off, and then I ended up driving the car by reaching over from the passenger seat and driving in reverse. and Jeremy was very impressed with me.

then I woke up in a really bad mood.

man, I've been seriously slacking on the blog.

Jeremy has been in Cinci for the night to do team building with his boss and this other chick who works up there. funny how their team building consisted of going out to dinner and then him being back in the hotel room at 7:30. lame

My head feels like it is going to explode. it really hurts me for some reason.

next weekend if blocks. this weekend I have to work saturday and sunday. don't bother me unless really necessary. because then I will be pissed, and then you would be pissed, and then it would be just one big pissed off situation.

Last night was at Cedar Point was a lot of fun, though it got off to a shaky start due to some rain. Apparently, even if it's raining very lightly, which it was, all of the roller coasters must shut down until the rain stops completely, or at least that's what one park employee told me. Another girl said it was until they were able to check their brakes in the rain. I'm not sure which one was correct because it quit raining shortly thereafter. We got on 7 rides last night, and 2 we rode twice for a total of 9 rides, which effectivly tripled our ride total from our last visit. After the rain passed, the weater was quite nice actually. We were expecting temperatures in the 40s, and I don't believe it dropped below 55 at any point. We actually didn't get out of the park until 12:30am, which has to be a record for Virginia. She doesn't usually want to stay past 9 or so. She's the one that had to convince me to jump on the last ride just at midnight. Usually I'm the one that would have convince her. Well, time to head back to the park for another full day. Hopefully it won't be too crowded.

wuick update before I take Perhaps for a walk and then head to bed.

Tomorrow we are leaving right when I get out of class on Friday and we are going up to Cedar Point. the park opens at 6, we are going to stay there until it closes at midnight, then we are going back on Saturday for the full day and headed back to Lexington on Sunday. we're both really excited about going.

I was trying to get a bunch done this week to get ready for it, but I wasn't too sucessful. that makes me sad. but, there is always next week and maybe I will be able to get stuff done on the car ride. most likely not, but a girl can hope right?

Last Thursday was an Adventure. I was invited to be a guest of my librarian at the Librarian's Fall Dinner at Kingfish on the River in the meeting room on the second floor. The view was really good in spite of looking like rain. The buffet was great and I even had lemon pie. But then the excitement started. The sirens started going off and the TV said a severe storm was heading our way. The waitress said we needed to go to safety and led us down a ramp into the part of the restaurant normally only employees go in. We had to duck our heads twice because of pipes and go down narrow steps into the very lowest level of the restaurant where the supplies were stored-huge cans of vegetables, salad dressing, soft drinks and the like. Of course being a storage area there was no place to sit and it was crowded and on the warm side. After about 10 minutes we were told it looked like the storm was going to stay at the other side of the river and went back upstairs. Outside across the river was lightening and I could see the effect of the wind on the clouds and trees. It was awesome in an unreal kind of way. The speaker Candyce Clifft from channel 41 started her speech. She said broadcast journalists will survive the Blog explosion because they are story tellers. To be a successful journalist, you must know how to read and write a story and how to prepare questions. You must also listen to the answers people give and follow up with questions related to what they say instead of always sticking with your prepared list. You must always remember you are asking questions for your viewers so even if the answer wouldn't interest you personally...
Then I had to go to the restroom and as I was getting ready open the door back into the restaurant, THE LIGHTS WENT OUT. I decided to open the door anyway and luckily there were two emergency lights that made it possible for me to get back to the table and my stuff. It wouldn't have been a good time to leave because the storm was at it's worst.The wait staff brought candles and the speaker went right on. I was impressed by her professionalism as well as her stories about stories she had reported. Next more sirens and the radio said a tornado was thought to be heading toward the VA hospital which was just down the street from where we were. It would have been close to impossible to have gone back down where we were before. However, there are two brick walls with a hall between them separating parts of the downstairs with the hall ending with walls on either end. The entire wait staff stood on the two sets of stairs with candles so we could see to get down safely. We sat on chairs against the walls when we got downstairs until there was a break between storms. There were no street lights until I almost reached I-65. There also wasn't much traffic. The wind was briskly blowing debris everywhere but it had stopped raining by then. I was so glad to get home. John wasn't aware of the drama since it wasn't as bad out by our house. Later that night, another storm came and woke me up but since I was safe in my own bed I just went back to sleep. All the time most of this was happening, I thought what a good story to tell. But Christy was sleeping when I called and wasn't impressed and nobody else has been home.

Today was a wonderful day. I kept smiling all day. I got up this morning early and went to do my OSCE. THen I knocked out two quizzes that were due, went to workout and kciked butt, then went to the library for a bit to study. Then I headed over to Kroger to do some immunizations and that I was cool. Of course the first guy I did I hit bone, so that wasn't cool.

Then I came home and met Jeremy and we went and got him two new suits and 3 tie/shirt combos. Then off to petsmart to get dog food. Perhaps has been having some bowel issues, so we got the regular Science Diet instead of the lite because hopefully it won't have an much filler.

Then Meijer to get a pumpkin and some other food. Jeremy is cooking this 15 bean soup, so hopefully that will turn out good.

what a good day. I've been needing a good day.

This weekend I went to my second class on cosmology. The matter that makes up us has been around since the beginning and we are made of the stuff of stars as is all the earth. We belong to the universe. Isn't that cool?
It was really hot when we went to the Lewis and Clark re-inactment across the river in Clarksville. At first we went to the Falls. The actual Falls and bank didn't seem changed from when I went there with Rebecca and Virginia with scouts but they have a paved ramp down close to where the fossils begin. The fossils are still sort of neat. There was a nice breeze.We didn't see anything about Lewis and Clark pobably because I didn't read far enough in the paper about it. On the door of the Visitors' center there were directions how to get to the re-inactment so we left. Mostly it was just keep turning left. You could see the Falls from a different angle. It was really interesting seeing the artifacts from back then and the reconstuction of the boats they used on their voyage. They seemed small for all those people. The Clark cabin seemed small for people to live in. I guess they didn't need as much privacy as we do. They must have been really short according to how short the bed was. All the windows were up really high so it would be hard to attack through them. We found out something we didn't know about tea. During colonial days and later, tea was ground up and made into slabs for shipping. That's the kind of tea they threw into the harbour at the Boston Tea party. The slab we saw was the size of a slender hard back book. We could see where someone had scrapped tea off to make some. While in the house someone fired off a cannon. It was loud. We saw old weapons and a man start fire without a match. John said he should have learned from a Hawaiian who make fire much faster. A little boy laughed at a kid goat drink milk from the moma goat.
I hope Virginia had as good a week-end as I did.

We needed the rain but not the storm. It was horrid going to work. Lightening and buckets of rain coming down so I-65 was flooded by hospital curve downtown and I had to go through water higher than my tires and pray the car didn't stop. It was as scared as I'd been in a long time. Luckily the sun was out by time to go home.

If I get one more damn group assignment WITH A DIFFERENT GROUP, I'm going to go jump off a bridge. I have to make 2 powerpoint presentations with two different groups, each of them TWENTY people. that is just logisitically impossible. i hate it.

We had to do immunizations today and the girl that did me hit bone on her first IM. Seriously, it wasn't even close to my deltoid, and I think she hit part of my clavical. now, I thought the SQ sucked, but when she hit that bone, pain went shooting done my arm all the way to my fingertips. and it still hurts. she must have hit a nerve.

I wonder if I can sue the school if I have permanent nerve damage.

sometimes it is so hard to remember the big picture when I have so much crap to do. Print out pictures for the board, read articles that I'm not going to be tested on, make powerpoint slides that don't mean anything, get cookies, send out emails to people who don't want to read them, meet with advisors who don't want to meet with you, give presentations to crowds that don't care, moderators bobbing their heads at you because you've gone 12 secs over... Big picture: I want to be happy.

Did you know the poverty level for a family of 4 is 21 thousand. Medicaid coverage goes out to people who are 200% above poverty (if the woman is pregnant). There is legislature currently that is suggesting that Medicaid coverage goes out to persons who are 400% above poverty.

This would mean a family of 4 who brings in $84,000 a year would still quailify for government assistance.

Today is Kentucky Kids Day and we had a band at school playing 60s hits for the last hour and a half of school. The auditorium was rocking and rolling. Earlier each grade had an hour to play; they had a rock wall to climb, bouncy slides, a dunking booth with the counslers, all sorts of games like you find at fun raiser picnics and popcorn--all for free. The kids were so nice while they were having a lot of fun. It was great.

I went to help out at the Diabetes Family Fun day today and my forearms got burnt. I put sun block on my face, but not my arms, and you can tell. Jeremy came the last hour and helped to break down the event, which was really nice of him. there was a lot of things for the kids to do and I think they had alot of fun. I got another free T-shirt out of it. I have a ton of free t-shirts

Then I came home and took a nap. being outside in the sun for 6 hours is tiring. today was the first day of Autumn and it was freakin 90 degrees out. isn't that crazy.

I wish that I had gotten more done this weekend. time just flies.

I have to work next Friday AND Saturday night. I don't know how that worked out. I guess it is all good. even if I just work 4.5 hours, my paycheck is still $50, which is much more than we spend extra every week on "fun stuff". I should be getting a big check sometime soon too because I need retro pay from back in June. I'm suppose to be getting $14 an hour, but I've been getting 11.50. they did change it to $13 at the beginning of the month, but that is still wrong. the distict manager is taking care of it though and he even called me last week to tell me that he hadn't forgotten about it.

This time next year, we will have the Passat paid off. that'll be weird having an extra $300 a month. Right now our goal is to save up money because I want to travel dammit before I have to be grownup and work a real job.

Prof. accused of sharing licensure exam questions

A University pharmacy professor is a defendant in a federal court case, in which he is accused of collecting and disseminating pharmacy test questions to students, according to court documents obtained by The Red & Black.

The National Association of Boards of Pharmacy filed the case Aug. 3 against the Board of Regents and Flynn Warren Jr., citing copyright infringement, misappropriation of trade secrets and breach of contract, according to the documents.

NABP has investigated Warren twice for these allegations.

The North American Pharmacist Licensure Examination and Georgia Multistate Pharmacy Jurisprudence Examination are tests required to obtain a license to practice pharmacy. The NAPLEX is used by all 50 states' boards of pharmacy, and the MPJE "combines federal and state specific law items to serve as the state law examination in 46 participating jurisdictions," according to a NABP news release.

At an Aug. 23 meeting, the executive committee of NABP decided to suspend all administrations of the NAPLEX and the Georgia MPJE beginning Aug. 25 and will not administer the test nationwide.

NABF said in the news release it has not decided when to reinstate the test.

"I cannot comment on this, given the current investigation," said University Provost Arnett Mace Wednesday afternoon.

Warren, who was reached at his home Wednesday evening, also refused to comment.

The College of Pharmacy referred calls to Tom Jackson, the associate vice president for public affairs. Jackson wrote Wednesday in an e-mail, "parties have been ordered by the court not to comment on the matter while it is in litigation."

While he would not comment on the investigation, George Francisco, associate dean of the College of Pharmacy, said Warren has taught the board review course at the University "for several years." Francisco said the class lasts three days and is available to both University pharmacy students and students at other institutions.

Warren is accused of copyright infringement because NABP owns the copyrights on the exam questions. Court papers say he asked students to memorize NAPLEX test questions and share them with him. He collected the tests' contents and created a review packet.

Warren is faced with these accusations because he was never "granted a license ... to copy, sell, distribute, prepare derivative works from, or otherwise offered to transfer the ownership of the copyrights of the NABP Examination Questions, to which NABP has exclusive rights," the court papers read.

Warren is accused of misappropriation of trade secrets because: "the NABP Examination Questions are original lists of questions containing technical information used for evaluating the competency of a candidate in the field of pharmacy," and the questions "derive economic and evaluative value from not being generally known and not being readily ascertainable by proper means," according to the documents.

The breach of contract charge stems from a 1995 settlement agreement, in which Warren and the University said they will "cease and desist for profit or otherwise from all past, present and future copying, transcribing or other infringing use of NABP copyrighted materials, including but not limited to patient profiles, sample questions, or other copyrighted information."

Francisco said he was unaware of the 1995 settlement, and the pharmacy school was not monitoring Warren's classes.

Last year, the BOR offered to pay $40 million for an addition to the College of Pharmacy.

Professors at other schools exposed exam study guide

According to a biography on the University's Web site, Warren has been a pharmacy faculty member since 1985. Before his July 1 retirement, he was a clinical professor and the college's assistant dean for student affairs.

Though he retired last month, Warren still is teaching elective classes for the pharmacy school, Francisco said.

This case arose after Warren offered an annual exam review course at Samford University.

Alan Ray Spies, an assistant pharmacy professor at Samford, said in an affidavit that he learned Warren was giving NAPLEX questions to students. Spies said he first found out this information in May 2007.

"Specifically, I learned that Mr. Warren's course materials include, among others, a series of questions, some 2,700 in number, that appear to be very similar, if not verbatim, to questions asked on the NAPLEX," Spies said in the affidavit.

Spies said he talked with some of his students about Warren's course in the affidavit.

"It soon became apparent to me that individuals who had just taken the exam were sending Mr. Warren questions which he in turn was forwarding to students who had not yet taken the NAPLEX."

Spies said he sent the information he found in an e-mail to Steven Pray, a pharmacy professor at Southwestern Oklahoma State University.

In his affidavit, Pray discussed his view of the importance of exam security for the NAPLEX.

"The knowledge base required to become a competent pharmacist is vast, taught via hundreds of hours of lectures, laboratories, and practical experiences," Pray said.

In the affidavit, Pray also discussed his thoughts about the extensive consequences for the exam if the questions have been compromised.

"A loss of hundreds or thousands of items, as it appears, has occurred through the activities of Mr. Warren, will force NABP to endure a loss of millions of dollars and will necessitate a radical overhauling of the examination pool," he said. "If this is required, the nation's pharmacy graduates cannot be licensed until a new, uncompromised NAPLEX can be created."

As he further researched the issue, Pray said in the affidavit that he found an online forum where students discussed Warren's course.

"This Web site also discussed an individual named 'Flynn,' who offered a review course and notes on passing the NAPLEX," Pray said in the document. "One correspondent on the Web site suggested that prospective examinees review the comments sent to 'Flynn' by other students, and another provided his address at the University of Georgia."

Pray declined Wednesday to speak for attribution about the case with The Red & Black.

Professionals feared news would 'impair confidence'

According to court documents, Pray sent the information to Carmen Catizone, executive director of NBAP.

In his affidavit, Catizone said Kerri Hochgesang, a lawyer for NABP, bought Warren's course materials on July 31. In her affidavit, she stated, "a true and correct copy of my payment receipt from the 'UGA Pharmacy Cont ED, Pharmacy Building' for the course materials" was given to her for $100.

According to Catizone, the materials contained at least three PDF files. On the NAPLEX REVIEW 2007 disc included in the materials, the files were labeled "NAPLEX MATERIAL PART 2, 2006 INFO FOR NAPLEX, and NAPLEX SAMPLE TEST W ANSWERS."

Catizone reported his analysis of this material "revealed at least 633 'sample' questions contained in Warren's 'review course' and/or were made available by Mr. Warren to candidates who gave him their e-mail addresses."

He also discussed his concerns about the value of the test if the allegations against Warren are true.

"The extent of the forgoing breach in the confidentiality of NAPLEX exam questions calls into serious question the integrity of the exam," Catizone said in the affidavit.

Efforts to reach Catizone Wednesday were unsuccessful.

According to an Aug. 6 NABP news release, "United States' Marshals seized materials and computers from the University of Georgia College of Pharmacy and the offices and home of Flynn Warren, Jr."

"NABP is disappointed and appalled that the

public trust and health were victimized, the security of the NAPLEX and MPJE breached, and the integrity of the licensure process compromised," Catizone said in the news release.

On Aug. 3, NABP motioned to file the case under seal, citing potential public panic as a result of the case.

"If the facts of this case are covered in the media or are otherwise publicly available, there is a significant chance that the confidence of the general public in pharmacists and the dispensation of pharmaceuticals will be impaired," NABP stated in the document.

"This case involved copyright infringement and misappropriation of trade secrets in highly confidential testing materials used in the licensure of pharmacists in many jurisdictions, and reproduction of the testing materials is required in order for Plaintiff to prove its case. Making this information publicly available will further compromise the licensure of pharmacists."

Warren filed a motion to stay Aug. 21, citing a lack of subject matter jurisdiction.

On Aug. 27, the court "provided the parties with a limited opportunity to conduct discovery related solely to the jurisdiction issue," according to court documents.

The court also stated, "there have been no final factual determinations by the court and no findings of liability on behalf of any defendant. Furthermore, the court has made no findings that would question the quality of education provided by the University of Georgia College of Pharmacy."

Customer complaint letter I sent to Delta

To Whom It may Concern,

On Friday, 9/14 I was traveling from New Orleans to Lexington, KY with a connecting flight in Atlanta and would like to share my Delta experience with you. What began as a routine trip quickly changed upon learning all flights into Atlanta were delayed due to the remnants of hurricane Humberto making its way across Atlanta. I want to note I was not informed of this when I checked in at the ticket counter. Now I'm a reasonable person and was not upset by the onset of delays. My complaints stem from how Delta handled the ensuing situation and the customer service my fellow travelers and I experienced as a result. Assuming my 6:30pm flight from New Orleans was delayed and my 10:20pm flight from Atlanta took off on time, I would miss my connecting flight. I asked two different ticket agents and neither offered me any assistance. I called the Delta help line and the information I received there said my flight was still scheduled to depart at 10:30pm. So as a precaution, I moved up to an earlier flight that was also delayed and boarded the flight around 5:15pm. For unexplained reasons, the plane did not take off for another two hours. Upon landing in Atlanta around 10pm, I saw my flight had indeed been delayed until 11:50pm, but another flight from earlier in the day had not departed yet, so I ran over to the gate to see if the flight had any seats left. I ran into a colleague of mine at the gate who had been at the airport since 2pm, and she was very agitated. She said the departure time for this flight had been pushed back several times without any explanation. As this flight was completely full, I headed back to the terminal with my original flight to wait it out. By the time I reached my gate, the other flight had been cancelled and my flight had been pushed back to 12:30am. Because of all the delays, the airport was in chaos. I waited in line for 45 minutes at the Delta service desk to inquire about my flight, because I suspected it may be cancelled, though I wasn't sure why at the time. The Delta associate told me my flight would not be cancelled. However, my departure time kept getting pushed back. By 12:15am, my posted departure time was 2:50am!!! I couldn't believe this to be true, but it was clearly posted. The Delta associates at the gate were too busy to ask because they were dealing with another flight cancellation that involved them deboarding an entire plane that would have been en route to Pensacola, FL. This flight was cancelled because it would be landing after 12am, which is against the local noise ordinances. Finally after the angry passengers from this flight were clear of the gate, the associate at my gate informed us the flight to Lexington was cancelled without any further explanation or direction except to head to the ticket counter to rebook. It turned out, after some persistent inquiries from several passengers, that both of the flights to Lexington were cancelled due to staffing issues as some of the crew members timed out. I don't understand why that was allowed to happen. If you know a staff member is going to time out, it seems that actions could be taken to call in someone, especially at the largest Delta hub. Furthermore, I don't understand why it took so long to let us know the flight had been cancelled, when it was probably known well in advance there would not be a crew available. This would have been much more conducive to your guests making the best of the situation instead of them sitting at a gate for multiple hours and becoming increasingly agitated as their flight departures kept getting pushed back without explanation. When I arrived at the ticket counter I was greeted by a line several hundred people long and only two ticket agents. Just when it seemed the situation couldn't get worse, it did. On a side note, my colleague that I ran into from the earlier flight to Lexington had rented a car and drove 7 hours to Lexington rather than waiting in this line. She same to this decision after the line hadn’t moved for an hour. Unfortunately she didn’t have my cell phone number, so I was stuck in Atlanta. I wouldn't get out of this line for 3 1/2 hours. I called the Delta help line again and waited to talk to a person so I could see about being on one of the early flights out of Atlanta, and was promptly informed the airport had locked down all of the flights to Lexington, that I couldn’t be helped over the phone, and my only option was to wait in line. Other people in line around me were being told they would be lucky to get on a late afternoon or evening flight. I called back again and this time the agent told me I had been booked on an 11:15am flight with no explanation how this happened, but I wasn’t complaining. Not when a lady next to me, who was a Sky Miles member was booked on a Sunday flight because her flight had originated with Continental and the agent on the phone refused to help her. I decided it would be pointless to leave this line without a boarding pass and would wait it out. After waiting in line about an hour 3 people near me decided to rent a car and drive back to Lexington. They told me they were on the 6am flight, so I promptly called Delta and talked to the only helpful person I encountered during the whole experience. She rebooked me to the 6am flight with no difficulties. I asked her if the flights had ever been locked down so she wouldn’t have been able to do this, and she said no that was untrue and asked why I thought that was the case. Now that I’m on the early flight, I’m worried I won’t make it through this line in time because it is going very slowly. Around 3am, one of the two ticket agents got up to leave and unsurprisingly, guests in line were very vocally complaining. She actually said to the 300+ people in line that she was tired and had been here all day. At this point I’m worried the situation is about to turn ugly as there were some very angry people who were tired of being treated like cattle and being kept completely in the dark about their flight situations. Consequently, the agent went back to her desk and security came over to keep an eye on the crowd. It wasn’t too long after this incident that additional ticket agents arrived and the line started moving. I finally received my boarding pass and was very thankful since several people around me were still on afternoon flights. There was still one more surprise though. After the flight had boarded the first couple of zones, the Delta associate at the gate informed the remaining passengers that she was very sorry because most of us were from cancelled flights but this flight was short a pilot and would be delayed until a pilot could be called in. The only positive I see in this, though only in retrospect, is at least I was accurately informed of the situation. After a one hour and fifteen delay, the flight departed and I arrived in Lexington without further incident.
I realize I went into lengthy detail about my experience, but I want to truly convey what an utter failure Delta’s customer service was during this entire situation. To me the worst aspect of the situation is the poor communication from Delta associates. It seemed like no one was in charge and the associates were left to fend for themselves, and as a result did whatever they could to keep guests from getting their faces. In this case that meant waiting to the last possible moment before informing guests of flight cancellations. Even though my flight cancellation was entirely Delta’s fault as was the ensuing scenario, no compensation was ever offered. In the future, I am very unlikely to use Delta ever again until I feel that a repeat of this situation will not happen. Delays due to uncontrollable circumstances are completely acceptable, but poor customer service is never acceptable, and I will only give my money to organizations that have great customer service.

well, three tests down. I only had one today and that was at 3:30 so I had all day to study for it. I didn't plan it too well though because I really needed another hour. I ended up saying up all night on Thrusday, minus a quick 2 hour nap. I got out of my last test at 5, and of course that means I didn't get home until almost 6 because Lexington traffic sucks. And I was going to go to sleep until I had to pick Jeremy up at the airport at midnight. But then his flight was delayed. and then it was delayed even more. by that point, I was waking up every hour to call him and see if he was getting ready to board. around 2 in the morning, Delta was kind enough to finally announce that the flight was cancelled. he then had to spend the night at the airport because he was hoping that he would get the 6 am flight into Lexington. of course, even that was delayed so he actually didn't get in from Alanta until almost 9 this morning. poor guy.

I think that Kentucky may actually beat Louisville. that's pretty cool.

after the fifth time that my butt fell asleep from studying so much today, I have decided to take a break. I've worked pretty consistently, but haven't gotten as much done as I would have liked.

I just gave the cats exactly one tablespoonful of wet cat food, so hopefully that will not go and yack all over the house like they usually do.

Monday, Jeremy is leaving for New Orleans to go to a training class, and he won't be back until Friday night at like midnight. that makes me sad. I have blocks starting on Friday too.

Last night I had to work until 10 and on wednesday I have to work from 3:30 until 8. And I get out of class at 3 on Wednesday and I have to go pick Maybe, Perhaps, and Zippy up at the vet before than because I think they shut down at 7. that makes me sad too.

Tomorrow, CVS is wining and dining all the interns at Tony Roma's. Apparently we get our meal paid for inclusing alcohol. there is like 30 people going, so I can't imagine the bill. I haven't ever been there, so I hope they have something vegetarian and virgin daiquries. I just looked at the menu... no veggie meals, so I will just get a salad and an appetizer, and maybe some side items. I won't eat very much tomorrow so that I'll have room:)
