Simpson enters not guilty plea

Gun with homemade silencer suspected as murder weapon

CATLETTSBURG — Authorities believe an Ashland man arrested last week for the February murder of a Flatwoods woman shot the victim with a 9 mm handgun fitted with a silencer fashioned from a plastic soft-drink bottle.

Boyd Commonwealth’s Attorney J. Stewart Schneider showed a photograph of the weapon Friday at an arraignment and bond reduction hearing for Timothy Scott Simpson.

Simpson, 23, is accused in the shooting death of 28-year-old Faith Kristen Fields Clay. Clay, who died of a gunshot wound to the head, was found Feb. 16 on a couch in Simpson’s garage apartment in the 4800 block of Boyd Street.

Police initially were not sure whether the shooting was a homicide, suicide or accident. However, investigators with the Ashland Police Department later said they suspected foul play. Simpson was ultimately revealed to be the “person of interest” police focused on following the shooting.

Simpson was arrested Sept. 21 after a Boyd County grand jury returned an indictment charging him with murder and tampering with evidence. Through his attorney, Michael Curtis of Ashland, he pleaded not guilty to the charges Friday.

Simpson’s bond was initially set at $50,000, but Circuit Judge C. David Hagerman later raised it to $250,000. Curtis requested Hagerman reinstate the original bond, saying his client wasn’t a flight risk and posed no threat to the community.

Curtis also said he and prosecutors had begun the process of discovery, or exchanging evidence, and the evidence he had received so far was “more good than bad” in favor of his client.

Also, Curtis noted gunshot residue tests performed on Simpson by police after the shooting turned out negative. However, Schneider countered that semi-automatic handguns, such as the one Simpson allegedly shot Clay with, did not ordinarily leave residue.

“We’re just about out of the GSR (gunshot residue business)” where those types of weapons are concerned, he said.

Schneider opposed Curtis’ motion to lower Simpson’s bond to its original amount. He said that in interviews with investigators, Simpson had admitted to firing the silenced pistol outside his apartment in prior to Clay’s shooting, “which is a bad idea to begin with.”

Schneider told the judge he thought a bond “somewhere in between the two figures” would be appropriate.

Hagerman said he was concerned about Simpson’s criminal record, which he said indicated a history of substance abuse and included an arrest in August for public intoxication.

“You know the saying — alcohol and firearms don’t mix,” Hagerman said.

Curtis told the judge there were no firearms in his client’s residence.

Hagerman ultimately reduced Simpson’s bond to $100,000 cash or $200,000 property.

Police have not released specific details, including a motive in the case, saying they could not do so because the seven-month-long investigation was still open.

I'm tired.

Turtle was sleeping on Jermey's nap early today and it was really cute.

I don't like people who are shady and lie. It's a horrible thing to do. I may be alot of things (rude, irrational, arrogant), but I'm not a liar. Even lying over stupid crap just completely rubs me the wrong way.

Tomorrow I think I will be well enough to work out. Jeremy and I made a commitment not to eat after 7:30 and we shook on it and everything, so hopefully we will be able to hold each other to it.

Saturday we are going to go see Joy dance which will be exciting. I should also go and help out at the health fair on Saturday, but I think I'm going to bail on it.

It's been like dragging fingernails down a chalkboard trying to motivate myself to do work tonight. It's not like I don't have a quiz on Friday and I know nothing about what's going to be on it and it's not like I don't have a 6-8 page paper due next Thursday that I haven't even started on. I was able to do somewhat of an outline tonight on it, but that's about it. I think I'm driving Jeremy crazy because I keep sitting there saying "why am I such a bum?" over and over again. and the TV is off and the ipod is off and I've finally convinced myself that the livingroom is too yelllow to study in. Because the color of the room totally can mess with your ability to think.

so now I will return to the UK spare bedroom and hope that colors will be more pleasing to my distracted mind.

I got my last two test grades back: a 97 for Lab and a 94 for endocrine, which I am very happy with. I have my test tomorrow for biology of aging, and I hope that goes just as well.

I have the flu (tummy and nose) and it really stinks. Well, I'm sure it would stink if I could smell.

Time for an update, I guess

I am currently sitting on the couch, using Jeremy's laptop (which is sitting on my lap) and it is awesome. I am so glad that I hadn't gotten the money form my grandmother's estate yet because I would have used it to buy a laptop and it would have been a complete waste. But, can I tell you that I LOVE using his laptop? I only need it like less than a week out of the month, so it's perfect.

I got three of my test grades back from blocks. 93% for Neuro, 97% for Law and drumroll please...... 100% on Immunology!!!!!! Isn't that awesome? I hope I did just as well on the other two. At least A's.

I have a test on Wednesday for my elective. I don't know what to expect. I need to write out a list of questions that I have to take to the review on Monday. I hope the review isn't a waste of time.

I was suppose to do some stuff this weekend, but my car and the weather didn't agree with me. Apparently, both of my low beam headlights decided to go out on sometime last week. Earlier in the week, they were both good and then both of them went out. How strange is that? We can replace them ourselves, but it would void the warrenty on the car because the bulbs we would use wouldn't be VW brand. So, Jeremy has to drop me off early at school (at 4:30 am) so that he can get to work at 5 and get in 10 hours before he has to go to Don Jacob's before they close. Oh well. I can get alot of studying done in the morning and there won't be annoying people at the library either. Seriously, why do people go to the library to talk on their cell phones? The least they could do would be at least whisper but they don't. And you know what else bothers me at the library? There are always these little kids there or these dirty old men looking at porn on the computers on the 5th floor. gross.

Maybe it was a good thing that my plans fell through today because I was really sick this morning and wasn't able to do anything besides curl up in a ball of pain until around 3. I wouldn't have been that much fun.

I guess that's all. I have some not to happy news, but I decided to put it at the end of the post so they people who don't care enough to read until the end of my post wouldn't be bogged down from it. The man arrested for Faith's murder is being held on $250,000 bond and he is not eligable for the death penalty due to KY law. take what you will from that.

Also, in other sad news, a third year pharmacy student was killed this weekend from the flash flooding that occurred in pretty much all of Kentucky. She and a friend were washed away into the storm drain system when they were trying to walk to their house after the police made the Taxi they were riding in turn away because of the water over the road. I didn't know the girl, but I have seen her around. I was telling Jeremy how sad it would be in their class tomorrow when the two people who sat next to her had to have an empty chair next to them for the rest of the year and always be reminded of her.

Man charged in February shooting

Timothy Scott Simpson jailed Thursday in connection with death of Faith Clay

ASHLAND — Police jailed an Ashland man Thursday evening in connection with the shooting death of a 28-year-old Flatwoods woman seven months ago.

Timothy Scott Simpson, 23, was arrested about 6 p.m. at his Boyd Street apartment and charged with murder on a Boyd County grand jury indictment handed down just shortly before, said Sgt. W.D. Hensley of the Ashland Police Department.

He was also charged with tampering with evidence, and lodged in the Boyd County Detention Center without incident, Hensley said.

The charges stemmed from an investigation into the death of Faith Kristen Fields Clay, he said.

Clay was found shot to death early Feb. 16 on a couch in a garage apartment in the 4800 block of Boyd Street.

It was unclear at first whether the shooting was a homicide, suicide or accident, but Ashland police later revealed they suspected foul play and were investigating as such.

Evidence pointed toward a homicide, and there was a “person of interest” in the case, police said then. Detectives continued by working closely with the Kentucky State Police Crime Lab, the state Medical Examiner's Office in Frankfort and Boyd County Coroner Keith Moore to determine the “manner and circumstances” of Clay's death.

Authorities did not release details in February about where or how many times Clay was shot, or what type of weapon was used.

That information, as well as any motive behind the shooting or the details of Simpson’s alleged involved, was unavailable from Ashland detectives Thursday night.

Clay was a 1995 graduate of Russell High School, attended Ashland Community and Technical College and Ohio University Southern, and was a mother of three.

I'm going to the library. any second now. I promise.

I'm planning on studying until Jeremy gets home from south Bend, which should be around 5 or so. that is if he left when he said he was planning on leaving.

If I don't go to the library, I know I won't studying for lab and law like I should. I already know the material well enough for multiple choice questions, but it's going to be some fill in the answer and short answer crap that I'm not ready for.

I'm interviewing my eye doctor on Wednesday for my paper that I have to write for law and I have to get questions together for her. I also have to study for our skill out session on Wed for physical assessment. I need to practive on Jeremy and make sure I can get all his vital signs in less than 5 minutes.

I also need to cathc up with my elective class because it has been put on the backburner for the past week or so. And i need to organize all my old papers so when finals come around I won't freak out.

and I need to get back to the gym this next week.

I just order Chinese (lots of it) and I'm totally going to gorge myself and watch TV in the livingroom for a few hours. I've earned it.

So, it wasn't a UTI. Note to self, no sex for Jeremy during pepper season.

This is totally going on my list of most horrifying and embarassing moments. It was the kind of moment when you want to go and bury your head and sqeeze your eyes shut really hard and just wait for it to pass... but then you realize you can't because you're sitting in the doctor's office with your feet in stirrups while the doctor is grilling you on your sexual practices.

And no, we don't use peppers as sex toys, contrary to what I KNOW the nurse was thinking.

In other news, I got a lot done this weekend, although I was hoping to get more done. But that's ok because I have two free afternoons of studying planned into my schedule next week to take care of that.

My mouth hurts and I'm pretty sure I have a UTI and I can't straighten out my arms from lifting weights yesterday.

So blocks coming up next weekend really sucks.

People who lie all the time suck too.

But at least I am ahead in studying. I should be good to go next weekend, especially if I have a productive weekend this weekend.

Zippy and Perhaps got their teeth cleaned yesterday. Zippy didn't take it very well.

Man, my mouth hurts like a female dog. I hate canker sores. Man, my vagina hurts like a female dog. I hate UTI's. I think I'm going to the clinic tomorrow. These cranberry concentrate caps aren't cutting it. I'm going to work on school work until bedtime now and feel sorry for myself.

mom's drama

I just got back from my followup with the surgeon. He said so far so good. Sometimes it'll turn out the fistula is too deep and will need to be raised or there will be little vessels that need to be tied off but it'll be a couple of months before he can tell for sure. It looks good so far though and I know I said that before but it makes me feel good to keep saying it. Okay. So I'm free until Nov. 2 when I go back to the surgeon.
Dr. McLeisch thinks my potassium was up for a reason other than the medicine since it wasn't up the week before I went in the hospital. Since my potassuim was just 3.4 when I went in yesterday, he said to start back on the blood pressure medicine and come in a couple of weeks for blood work to check level. And to decrease the senispar because my calcium levels were down and get that level checked, too.
Work is going well. The little sixth graders are all polite and guiet. I hope it lasts a month or two. Seventh grade girls are the worst. They are 10 times louder and ruder than the boys.
John's aunt died Tuesday. He hadn't really had much to do with her since he left his parents. I think I met her once. I can't tell if it bothers his dad (her brother) or not. We'll be at the funeral home some tomorrow.

I applied for a job at ole wally world. I talked to the pharmacy manager and he said that he would like me to work Tues and Thurs afternoon and the weekends. I don't know how much on the weekends, but hopefully, not much.

I hope that I don't regret it.

Tomorrow, both Zippy and Perhaps are getting their teeth clean. And tomorrow afternoon, we are going to the KAPS pinic, which should be fun.

Today was a good morning. well, late afternoon. We slept late and then got up and went to eat at the Olive Garden ( can't go wrong with the endless pasta bowls) and then to the mall. I got two speedos for like $42 because they were having an awesome sale. I got both of them in the same size, but one fits and the other is sort of suffocating. Hopefully, I'll be able to breathe when I haven't just eaten the endless pasta bowl.

Lissa, I can't get a hold of you on your cell phone, but if you want to go swimming anytime this week, let me know. I am pumped and ready!

I've taken all my quizzes that I needed to take and got perfect scores on them. Now, I guess I will study for endocrine some before Jeremy gets home. Tonight is the LAST NIGHT EVER that Jeremy will have to work on the weekend. That is so EXCITING.

Jeremy is going up to a Notre Dame game soon and we are going up to Cedar Point the last weekend it is open again this year. Gosh, it seems so strange having weekends free.

I stopped by the walmart on New Circle to see if they are hiring any interns. They told me to come back on Tuesday because that's when the manager will be in. I am so torn about getting a job or not. Jeremy is going to need a new car soon. His carmaro is on its last wheels, and the car he wants is in the 30,000+ range. and we need to finish paying off my car so that we won't have two car payments. but it seems like such a shame to get a job and have to work weekends when he's off. But the intern pay at walmart is $14 an hour, which is really hard to pass up. And I could transfer to the Walmart that they are building in Hamburg once they get it finished. And I don't think that the school year will be that stressful this year. And I know that I'll need a job this summer. I guess I will go and apply on tuesday and just leave it at that. I don't know... any advice from the readers?

time for an update

I took a nap when I got home but when I woke up I felt like i was going to throw up and that wasn't too much fun. But I feel better now.

I was able to work out three days this week, which made me feel good. I found the best machine to work out on with a good view of the TV, so hopefully i will get that machine more often. Watching TV helps me forget that sometimes workign out sucks.

My little toe on my left foot hurts and I don't know why.

They moved up jeremy's start date for his new job to next Monday. It seems so strange that this may be the last weekend that he hads to ever work.

This weekend I'm getting a bathingsuit from Dick's.

I need to find that stupid book for my elective.
