Judge sides with Fayette PVA in Walgreens' lawsuit that could have cost schools millions

A judge ruled this week in favor of county and state officials in a lawsuit brought by Walgreens Co. that threatened to strip millions of dollars from Kentucky's school districts.
In a ruling issued Wednesday, Fayette Circuit Judge Tom Clark said Fayette County Property Valuation Administrator David O'Neill had properly assessed the value of the Walgreens pharmacy at 2290 Nicholasville Road.
Clark upheld an earlier finding in favor of O'Neill by the Kentucky Board of Tax Appeals, saying the method used to value the property "was not arbitrary or capricious, nor was it clearly erroneous."
If O'Neill and other PVAs in the state had lost the case, the potential change in how PVAs assess commercial property could have cost Kentucky's 173 public school districts "hundreds of millions of dollars," O'Neill said.
Walgreens' store on Nicholasville Road is worth $5 million, according to O'Neill, but the company has contested its property tax bill for the past two years, paying the taxes as though the store were worth $3.4 million.
That, and similar appeals for six other Walgreens in Fayette County, amounted to a $200,224 loss for Fayette County Public Schools, which gets 54 percent of its funding from such local taxes.
Statewide, Walgreens has appealed the valuation on more than 20 of its 94 stores to the state board of tax appeals.
Central to the company's lawsuit was its contention that Kentucky PVAs are using the wrong methodology to determine the value of Walgreens stores, resulting in inflated values and unfairly high tax bills.
There are three accepted practices for determining a property's value:
■ For a residential property, PVAs usually base their estimates on comparable sales in a given neighborhood.
■ For a new commercial property, PVAs sometimes look at the construction cost.
■ For an existing commercial property, PVAs usually determine a value by calculating how much income it can generate. In other words, what could a real estate holding company collect by renting the property over time to a corporation, such as Walgreens?
Walgreens contended that its stores should be assessed based on the value of comparable properties, not its cost to lease the stores.
O'Neill said Friday that he "was always confident that our methodology for assessing these properties was sound — and that the law is clear — so obviously I'm thrilled that the judge agrees and that we can now move forward."
Phil Caruso, a spokesman for Walgreens, declined to comment Friday.
Caruso previously defended the company's appeal, saying Walgreens was behaving "like any taxpayer who believes their real estate assessment is excessive."
If Clark's ruling stands, Walgreens will have to pay taxes on the PVA's assessed value of its properties, plus interest.
In an unusual twist, a handful of school districts helped fund the fight against Walgreens.
O'Neill and officials in Fayette County Attorney Larry Roberts' office sought funding from school officials in Fayette and other counties to defend the Walgreens case before the Kentucky Board of Tax Appeals.
Fayette County Public Schools contributed $8,737 to the cause, and other Kentucky school districts pitched in for a total of about $26,000.

vomiting and shoveling

Beckett threw up three times today.  The first two times on Jeremy, the last time on me.  It was so sad because he threw up all over me while nursing, then wanted to immediately start nursing again because he couldn't understand why he needed to get cleaned up when he felt so bad.

The entire driveway was a sheet of ice and I spent an hour trying to clean it off. did a pretty good job, and Wyatt came out and helped me a bit.

Liam and Jeremy went out sledding at Shriner's this morning and it went a lot better than the last time we went.  I stayed home with Beckett and Wyatt and watched Frozen.

I am super sore from shoveling, much more so than earlier this week.  The icey slush is much heavier and my back is feeling it now.

I was able to do an hour long P90x workout tonight.  Lots of lower body stuff, which was good since I was so sore from Shoveling.  The boys came down and actually played in the basement with me down there, which they never do.  

Jeremy made French onion soup, complete with cheese and crusty bread.  It was super rich, and after so much vomiting today, I was SO not into it.  I know it hurts Jeremy's feelings when I'm not 100% into the food he cooks, but man, it was like eating a bowl full of butter.  And he ate two and half bowls of it.

I didn't get to go to Fat Tuesday. Liam went in my place. Babysitter couldn't get out of her neighborhood. Makes me sad.

 I shoveled the driveway three times yesterday. Jeremy did it once. Feb 2015, the year of the 10 inches. Another 3 years today.

Snow and Guns

Went and got bread and milk (because we were out of bread and milk).  Also got a bag of salt and a big ice breaker upper thing that was 50%.  Target already had all their winter gear on clearance.  Not able to get snow boots or mittens for the boys, which it what I was wanting to get with that trip.  Couldn't even buy Liam a pair of girls boots that weren't just for dress.  Got him a pair of heavy duty hiking shoe like things, and that was lucky because the only pair they had were in his size.  If the snow that is coming is as bad as they say it is going to be, then it won't really matter.  Might be able to put him in really long pants and tape them around his ankles for playing outside.

Here is the activity we did today... We put food coloring into water, and put them on the porch to freeze.  Tomorrow, we will have blocks to play with.  Granted, it might be too cold outside to play, so we might bring them in to play with in the bathtub.  Tomorrow we have the day off, but I was going to go into work for a bit to get caught up... But likely I will not be able to with all the snow that is expected.

Here are my guns.  It's crazy to think how far I've come upper bodywise.  I remember when I first did Insanity, there was a section where you had to do 16 push ups in a row, and I thought, there is never a time when I will be able to do this.  Now, I can do 200 push ups in a workout (and it will suck), but I never have any doubt that I can get it done.  Now, I just need to get that darn pull up off my bucket list.

Blah, I am so over this cold!  Summer time is so much happier- so many more things to do, so much brighter and warmer. 

Counting down the days until I can stop pumping at work.  It will be glorious! Sad that my boobs will be smaller, but maybe they won't get too small too quickly- who knows how long Beckett will want to keep nursing in the morning and night.

Doing a Yoga video tonight, and tomorrow an hour long back and chest video that is new.

We have a date night set up with a babysitter on 2.17.15. Something to look forward to, but I will miss spending time with the boys that day.

Looking through some old baby pictures of Wyatt and Liam.  Beckett looks almost identical to what Wyatt looked like when he was 10 months old.  It will be interesting to see what a year from now will tell  I've been meaning to get family pictures done, but that is easier said then done.  I have to get Wyatt's haircut, and that is an ordeal in itself when you have three little ones to watch.

Jeremy made some chocolate pies, and man, they are good.  He has been using the pressure cooker and the mixer like crazy for the past month. 

I'm nearing the end of P90X3-- just a few more weeks. The last month is a mismosh of the videos, so it will be nice to mix it up.  and then.... I start the most amazing awesome hybrid schedule of insanity/P90x/Insanity Max/P90X3/Piyo/T25--- were basically I do a different workout every single day for 18 freaking weeks.  WHHHAATATTTT? it is going to be awesome.
